Providers of these models have had to document the data used for training ever since. Certain labeling requirements also apply.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\">Now comes the decisive step: On August 2, 2026, the rules for High-Risk AI systems take effect. This is the stage that impacts mid-sized companies (the Mittelstand) most severely. Because this isn\u2019t about providers of large language models, but rather about companies deploying AI within their business operations.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\">Germany has simultaneously initiated the AI Market Surveillance Act (KI-MIG), intended to regulate the national supervisory structure. The Federal Network Agency (Bundesnetzagentur) is expected to become the competent authority. However, the legislative process is not yet complete. For companies, this changes nothing: The AI Act is an EU regulation and applies directly, with or without accompanying German legislation. The high-risk category is the relevant one for SMEs (small and medium-sized enterprises). And it is broader than most expect.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\">Classification depends not on the company itself, but on the intended purpose of the AI. A 50-person operation using AI for candidate pre-screening is subject to the same obligations as a DAX-listed corporation. Company size only plays a role in the rigor of documentation, not in whether the rules apply.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\">High-risk AI systems encompass, among others: AI in recruiting and personnel selection (candidate screening, resume analysis), AI in credit granting and creditworthiness assessment, AI in quality control of critical products, AI in insurance and risk assessments, and AI for controlling critical infrastructure.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\">In concrete terms: If a mid-sized manufacturer uses AI for quality control, it falls under high risk. If a recruitment agency utilizes an AI tool that pre-sorts applications, it falls under high risk. If a financial service provider employs AI for credit checks, it falls under high risk.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\">Excluded from the high-risk category are: AI-supported text generation for marketing, chatbots in customer service (as long as no automated decisions are made), and AI for internal data analysis without direct impact on individuals. Those using ChatGPT for emails need not worry. Those using AI for personnel decisions do.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\">A gray area exists that affects many SMEs: AI functions embedded within existing software. If the CRM system automatically prioritizes leads based on purchase probability, this can fall under limited risk. If the HR tool automatically sorts applicants by suitability, it is high risk. The distinction lies not in the tool, but in the impact on individuals. Every system that makes automated decisions regarding natural persons or significantly influences them is under scrutiny.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\">According to the <a href=\"https:\/\/mybusinessfuture.com\/foerdermittel-bremsen-den-mittelstand-warum-einfach-machen-schneller-ist\/\" style=\"color:#F21F05;text-decoration:none;\">KfW study on AI usage<\/a> by Germany\u2019s state-owned development bank, 20 percent of German SMEs already employ Artificial Intelligence. That amounts to nearly 780,000 companies. Among larger SMEs with more than 50 employees, the rate stands at 36 percent. The question is not whether the AI Act affects SMEs. The question is how many of the 780,000 realize it applies to them.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\">Added to this is a structural problem: Many SMEs perceive AI as something they might \u201cintroduce sometime\u201d. In reality, they are already using AI without knowing it. Microsoft 365 Copilot, Salesforce Einstein, SAP Business AI, HubSpot Predictive Lead Scoring-all these tools utilize AI models in the background. The inventory must therefore begin with the software being used, not with an AI strategy paper.<\/p>\n<h2 style=\"margin-top:64px;margin-bottom:20px;padding-top:16px;\">The 5 Obligations for High-Risk AI<\/h2>\n<p style=\"line-height:1.8;margin-bottom:20px;\">Any organization operating or deploying a high-risk AI system must fulfill five requirements starting August 2, 2026. None of these are optional.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\"><strong>1. Risk Management System:<\/strong> A documented system that identifies, evaluates, and minimizes risks of the AI application. This does not need to be a 200-page document, but its existence must be verifiable. What risks does the AI carry? For whom? What happens if it makes the wrong decision?<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\"><strong>2. Data Quality:<\/strong> Training data and input data must be documented and checked for biases. If a recruiting tool was trained on data that disadvantages certain demographic groups, that constitutes a violation. Responsibility lies with the operator, not the provider of the tool.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\"><strong>3. Technical Documentation:<\/strong> A description of the AI system, its functionality, its limits, and its intended use. Including performance metrics and known weaknesses. This is what most mid-sized businesses must demand from their AI providers.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\"><strong>4. Human Oversight:<\/strong> Every high-risk AI must be designed so that a human can monitor, understand, and override decisions in case of doubt. No fully automated rejection of job applications. No automatic blocking of credit lines.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\"><strong>5. Transparency and Logging:<\/strong> Users of the AI system must be informed that an AI decision is being made. The system must maintain logs that enable traceability. Every decision must be reconstructible. Not in real-time, but retrospectively when a complaint or audit arises.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\">These five obligations may sound abstract. In practice, they mean: Anyone purchasing a recruiting tool with AI functionality today must request documentation, bias tests, and decision logic from the provider. Failure to do so means you bear liability yourself in case of dispute. The EU AI Act deliberately places responsibility on the operator, not just the provider. This is the point many mid-sized businesses overlook.<\/p>\n<h2 style=\"margin-top:64px;margin-bottom:20px;padding-top:16px;\">What SMEs Must Do Specifically Now<\/h2>\n<p style=\"line-height:1.8;margin-bottom:20px;\">117 days isn\u2019t much time. But here\u2019s the good news: For most SMEs, the workload is manageable if they get started now. The bad news? Anyone waiting until July will face serious issues.<\/p>\n<p style=\"line-height:1.8;margin-bottom:20px;\"><strong>Step 1: Take Stock (1-2 Weeks).<\/strong> Which AI systems is the company currently using? Not just the obvious ones like ChatGPT, but also embedded AI within existing software. This does not need to be a new full-time position. This sounds manageable. Compared to potential fines, it certainly is. However, this assumes the inventory identifies which systems are affected. Without this first step, neither effort nor costs can be realistically assessed. Most SMEs fail not due to budget constraints, but due to a lack of visibility into their own AI landscape. Those who complete the inventory will often find that only one or two systems actually qualify as high-risk. The effort then becomes manageable. Uncertainty stems from ignorance, not the regulation itself. The AI Act does not penalize the use of AI. It penalizes the uncontrolled use of AI in areas impacting people.
